A very well written letter to Dr. Cumming from another poster on Yahoo!: The following post was written by "DD_Fact_Finder" Mar 26 1999, 5:17AM EST the link is as follows:post.messages.yahoo.com @m2.yahoo.com With regards to all, Clement ************************************** Dr. Cumming: You wrote: > Thermo Tech(tm) has already commenced legal proceedings > in the Supreme Court of British Columbia against certain > named individuals. Thermo Tech(tm) has also delivered a > formal "cease and desist" demand to individuals who have > been identified to date. Could you please advise as to what Jurisdiction of the BC Supreme Court these legal proceedings have been filed with? As "Civil" proceedings are public information once filed it would allow "Fact Finders" to verify the "TRUTH" of your statements. Past history with Thermo Tech makes one very leery of taking anything coming from the Company at face value. I await your reply so that I may verify same and subsequently the credibility of your post. > We encourage all posters to frankly express their views > on all matters they feel concern Thermo Tech(tm) and its > shareholders. So long as posters are able to contain their > remarks to what is true, Thermo Tech(tm) will have no cause > to intervene. If I was to say that Thermo Tech Technologies is poorly run, would that be cause for Thermo Tech to intervene? While you may feel that the company is run well others may not and the "truth" becomes subjective. Should posters first confirm with Thermo Tech whether their subjective opinions comply with Thermo Tech's perception of fact before posting in fear that there may be an intervention? Perhaps you would be so considerate as to enlighten everybody as to what is "TRUE". Was it "TRUTH" when Rene Branconnier and Wayne Hanson reported on the Emerging Company Report Last October that Thermo Tech was on track to meet or exceed 2000 tonnes/day processing by calendar year end 1998? If so what event happend that would result in it falling WAY short of expectations? While we are on the subject of "TRUTHS" please post for all to see the "TRUE" responses to these questions many of which have been asked numerous times and which have fallen on deaf ears. 1) How much waste is being processed at Richmond? Daily/Monthly 2) How many tonnes/day are secured with put or pay contracts? 3) When will Richmond be profitable? 4) What is the size of the Richmond Facility Bulding? 5) How much did it cost to construct the building to hold the TMP? 6) Is the Richmond Facility upgradeable to 600 tonnes/day?) 7) What is the monthly cost for the lease of the Land? 8) From BCTV News - Did Richmond cost $26 MM Canadian to build? 9) Has the $600,000 in Provincial Tax Liability been satisfied? 10) Is Richmond fully operational and capable of 100% capcity being 400 tonnes/day? 11) Have ALL the Bills been Paid for Richmond? 12) Are there any other legal proceedings against Thermo Tech or any of it's subsidiaries either in BC or Ontario or any other jurisdiction? 13) How much money has been raised through dilution of 100 million plus shares since Trooper Technologies filed legal proceedings against Thermo Tech in the Fall of 1997? 14) Where can we obtain a full accounting of the monies raised? 15) Is the dilution continuing and if so for what purpose and at what Rate? 16) What is the status of the note payable to the Baha Company? 17) What are the Tipping Fees for waste at Hamilton? / Richmond? 18) How much does the end product demand at Hamilton? / Richmond and where is it FOB? 19) Is Thermo Tech taking steps to negotiate a settlement with Trooper Technologies prior to April 1st what is the probability that a settlement will be reached? 20) What is the "TRUE" status of Chino? Time Frame? 21) Does the Mark II process achieve 100% Thermophilic Aerobic Digestion resulting in single cell microbia upon completion? 22) Can I or anybody else get a RANDOM sample for independent analysis? 23) What is the minimum Tipping Fee and monthly volume of waste required to make the process profitable? 24) How profitable can a 600 tonne/day plant be? Please support you answer with "TRUE" figures. 25) What are the specific TERMS of the financing? This is a short list and a good starting point. I, and I am sure many others, will anxiously await your "FACTS" in response to these questions. Part II to follow: > If any reader is concerned by any information posted > at this site, we invite you to contact us directly so > that we may respond to your concerns with true facts. Firstly, lets Define TRUE & FACT: TRUE: ACCURATE, GENUINE FACT: SOMETHING TRUE AND ACCURATE So to say TRUE FACTS you are being redundant. Will each and everyone that chooses to call Thermo Tech about their concerns receive the same "true" answer? Should we ask to talk to you directly? My experience with IR is one of contradiction & ambiguity and more resembles a fast talking salesperson than a company representative disseminating "FACTS". I think it would be more prudent if you answered the questions in this forum so that all could see the "TRUTHS" without fielding a mass of calls from each independent investor. Remember, just the "FACTS" please. Why doesn't Thermo Tech quell the claimed lies with a rebuttal stating what the facts are? It is easy to make claim that a particular statement is a lie, but why is it a lie and what are the facts to support it? Again, Dr. Cumming, it would be my preference to have these questions addressed in this forum. When may we expect your response? Dr. Cumming will you and Rene Branconnier be attending the court hearing in the Supreme Court of British Columbia on April 1st? I will be attending the hearing myself. If you choose not to address my questions and concerns in this forum may I meet with you after the hearing and allow you to respond to me face to face? All that I would ask is that you allow our conversation to be taped and that you allow me to disseminate via any media I see fit the "facts" that you report? Have a nice day!!!
