as far as your additional questions here In other words how in the world can we regulate against stupidity? I wish I knew. But this concern is not limited to derivatives. How do you regulate stupidity in other areas? My argument is that you need to look at what is effective and what you are really trying to accomplish. See my post above. As far some banks writing large deals with insufficient review, the Fed already reviews for that. But frankly fraud is a bigger concern. And the only way to do that is to conduct rigorous operational audits. Regulating specific transaction types won't effect that.
