It's not considered material, so doesn't matter (legally speaking). There's nothing wrong with trading on non-public info, and there's nothing wrong with having material information (as long as you don't trade on it). The thing that gets you in trouble is trading on material non-public information.

FWIW, Herb Greenberg quoted him earlier this week saying much the same thing. His arguments sounded reasonable to me.

Moron Murphy is a piece of work, Never owned MSFT AOL MCIC and the list goes on. This turkey shorted QCOM and stated that CDMA did not work in hongkong, this was a few years back. He has got to be the biggest loser of all times. His favorite stocks LGND IDTI and a slew of others are in the DOG HOUSE and some are O O B. I can not fathom why this IDIOT is regarded as a technology expert. His stats that he publishes are all humbug. Techs have soared and he has lost money.
Somebody should sue him for misrepresentation.
