My understanding is that anyone without contradictory papers (or charges against them who may be held) who claims admission as a refugee is admitted on parole to the US and subject to a later hearing before an administrative judge or hearing officer to whom evidence supporting refugee status can be submitted and counterclaims be assessed. European countries have similar rules, except Germany, a popular destination, now accepts only "first stop" refugees (except of German ancestry) -- i.e. not second-hand refugees from neighboring refuges.
