Since I do not have the precise wording of his denial in front of me, I can't comment definitively. It seems to me that he was denying analyzing Roe, but I could be mistaken. Anyway, I don't think that he was required to pass a litmus test, but was appointed due to a generally conservative orientation, which is normal.

After all, Thomas never, ever gave a thought to Roe before he was appointed. He said so himself! Under oath!
