This is very cute on the part of the company. The company commits to nothing but if any note-holder wishes to tender their shares they must agree to consent to the ammendments. If a majority fail to consent there is no tender. If the consent is agreed to by a majority the company may or may not repurchase the debt depending on how much financing it gets for that purpose. We won't know until April 23, how successful this strategem is. Probably depends on how many big investors are out there. Can the company call the notes? If so at what price?
