I think this sums up the key issues from Abers side:

"The lawyer also notes the partners approved budgets and exploration programs in an informal manner and they have previously waived the requirements of the formality of written notice. This pattern of notice is particularly crucial to the dispute between the two companies."

They also mention that sometimes there was a place to sign and sometimes not. They don't say whether that was the case this time. I don't think the bit about Winspear not giving Aber reports on time, has any relevance. The bit about the $50 million offer may be relevant. I can't see any relevance in the bit about Winspear press release accuracy and name dropping.

So far it appears as though Aber has a case. If they did follow an informal practice without written notification I would expect Aber to prevail. It will be interesting to see what Winspear has to say. It would be interesting if we could see all the issues but I doubt we will.
