Yes, Berg's $7.5 million is still available, but there are conditions on these funds. Maybe he will waive the conditions (or maybe they will, or have met them) and they are drawing them down as we speak.

I don't know if this would be considered a material event by the SEC. But even if not, I would think the company would want to announce to their shareholders if are indeed now able to tap into this money. That might relieve some uncertainty that is created by their own filings.

mooter - what about the msft ads for the nec handheld with 12 hour battery capability? this wait is getting longer with the aols and netes buzzing by - any rumblings? things seem to be swimming at lay.
