Cat got Spidey's tougue? Cowardly little bug (ger) isn't he? Never mind. FINALLY we've got the transcripts of the recent hearings. It's gonna take awhile to process all of it, but here's something awfully funny:2/29/99 Judd to Sylver... Q: Mr. Sylver, if I understand your testimony, exhibit 3A is a copy of a document your lawyer created, is that correct? A: No no no no. Q: Is-- A: Let me explain it again. Q: No. You can answer my questions, please. A: Okay. Q: If the court thinks I'm out of line, the Court will tell me. Mr. Sylver, did your lawyer create an original of a document entitled promissory note to be signed by Shoreline Securities, Limited? A: No. Mr. Landish: Your Honor, I'm simply going to ask could we know what attorney. I think we're entitled to that foundation. The Court: Well... Q: Mr. Sylver, did your lawyer ever create a promissory note for you to send to Mr. Mann? The Court: Any of the lawyers representing him. Okay. Q: Let's start again. Mr. Sylver, did any lawyer for you or for Amazon ever create a promissory note to send to Mr. Mann? A: No. The Court: The answer is no? A: Correct. It was on the computer. The lawyer told me it was on the computer. The Court: Well, I'm not sure...Why don't you go ahead? Q: Mr. Sylver, did any of your lawyers present to you a promissory note that you sent to Mr. Mann? A: No. Q: Did any of your lawyers ever send Mr. Mann a promissory note? A: No. Q: Did any of your lawyers have a promissory note in the form of Exhibit 3A? A: Yes. Q: Which lawyer was that? A: Robert Qualey. The Court: Who? I'm sorry. A: Robert Qualey, your honor. Q: Did your recieve a copy of that promissory note from Mr. Qualey? A: Yes. Q: He printed out a promissory note, is that correct? A: Well, we got it from the computer. Q: Mr. Sylver, did Mr. Qualey print out from the computer -- A: Yes. Q: -- a copy of the promissory note? A: Yes. Q: And did you then fax that to Mr. Mann? A: Yes. Q: And is that what you faxed, the original of Exhibit 3A? A: Okay. We got the copy. We have the -- the -- it was on real paper, and it's typed on the printer, the laster printer, and then it gets in the fax machine, and it's faxed to Cancun Mexico to Joseph Andy Mann. Q: Where is the original? A: The original we didn't use anymore. Q: Where is the original. A: Okey. In the garbage, that piece of paper. (Much more of this goes on, with Sylver reluctantly agreeing that 3A is exactly what he got back from Any Mann, until we get to this classic exchange...) Q: So by Mid March, 1998, Whitecliffe Investment Funds and Shoreline Securities, Limited owed Amazon a debt of $1,000,000. A: That's right. Q: That was an asset of Amazon. A: I don't know accounting. I don't know what you're talking about.
