I'm no judge but have been in front of a few. My take is that if this IS a part of the defense it is a very weak statement and will be met with the judge looking over the top of his/her glasses and asking whether or there was ample time to express their concern before the deadline expired.

The precident of past mining practice and the history between these two companies will likely be the key point. Any thoughts?
