I would like to know why CyberBroker interprets the five minute SOES rule so you can not use SelectNet Or ECN,s on same side of market after you SOES for tier limit.

Perhaps my example left the impression that the sequence is important, or that size was the issue. It is not. I have to stand by the position I stated. I agree with you that the 5 minute rule does not apply if ALL orders within 5 minutes are non-SOES orders. But your original question states that you have had a SOES execution, and are trying to use SNET or an ECN for an additional same-sided execution within 5 minutes. The rule, as I understand it, is that you cannot have two executions on the same side within 5 minutes if EITHER ONE of them is a SOES order, regardless of whether the sequence is SOES first or SOES second.
