CYOE--some thoughts

we now know that cyoe issued warrants to comdisco to smooth over the risk associated with the appollo telecom, crescent, and ??<insert your guess here> transactions...

this is not illegal...comdisco takes warrants in exchange for the risk it is taking on certain leases quite frequently...

however, the illegality may lay in the failure of comdisco and cyoe to disclose this relationship...this is my question...

was cyoe required by law to disclose

1) that it gave cdo warrants??

2) that the equipment sale was really to cdo and not crescent??

3) same questions for the appollo transaction as well as the unknown 3rd transaction???

just trying to get my bearings straight...
