Couple of differences between RNWK and NSCP in relation to MSFT.
1. RNWK has a much superior product and is putting more emphasis than MSFT into improving the product. (That's what my friends in Redmond say, and what is evident from progress on media players and servers the past 2 years.)
2. MSFT is and will be skittish about using the Windows Platform and NT Server in particular to try to kill RNWK given the DOJ attention.
3. RNWK has entered into a large number of important strategic relations that effectively shut out MSFT on this--AOL, @Home, Excite and others.
4. Rob Glaser is a lot tougher and smarter than Jim Barksdale and Marc Andreeson put together.

here are a few names you may be familiar with that beat microsoft head to head ....Oracle,Intuit,AOL, Symantec(act),MSNBC is 50% owned by msft and is never in the top 15 in the ratings, Lotus and there are too many others to mention.
Msft won the BIG one and that was the one on operating systems...As the justice dept. likes to point, they use that to an unfair advantage to TRY to win their other battles...they don't win them all by any strech of the imangination....I think they may very well loose this one with rnwk and watch real close, because they are beginning to loose the NT space to novell and linux....They have probably lost 15 points of market share just in the last 6 months
I suspect they will loose or settle with the justice dept. but it is a mute point now...the landscape has changed and folks aren't afraid of them anymore.....now IO folks are more than happy to buy an add-on from a different vendor if it will help them...they aren't afraid of msft...msft is afraid of the competition.....and that isd a little scary in itself

For the record:

Late 98> MSFT sold its 3M shares in RNWK, Gates to Glaser: "Screw you."

Early 99> MSFT incorporates Real Player into MSIE 5.0. Gates to Glaser: "I still hate you, but your product is good and you have 85% market share, and I need your product in mine to help me get to the next level."

Looks to me like MSFT wants desperately to give Glaser the shaft, but could not do it with their new version of MSIE. So let's can the MSFT as a competitor talk for the time being, it is a little way off and the stock can rocket before MSFT can mount aeven a semi-serious challenge.

There are competing technologies. It is patently obvious from the two occurrences that Glaser has Gates' number for the time being and near future.

Understood. But once again I will restate that 85% market share is the key here, much like a MSFT's dominance in the OS business. NSCP's browser market share was no where near 85%. I think this is where the money is.
Over on the Yahoo board they've been claiming a 2:1 was already approved this weekend. Sounds like a lot of spam but not an unlikely scenario much the same as ABOV last week. Though wishful thinking, a 3:1 would really light things up. Good luck.

... can you name a company that won its battle with MSFT?

AOL & Intuit are the two foremost that come to mind. True it is a dunting task, but you forget perhaps that Glaser is a MSFT boy? He knows how to play (and win) the MSFT game.
