   17       indicate to the Court exactly what document that is, please.
   18       A.    3-A is the original promissory note that was written by
   19       attorney that was faxed to Joseph Andy Mann for approval,
   20       and then --
   21                           THE COURT: Now, when you say it is the original,
   22       is it a copy of the original? Is that what you're saying?
   23                           THE WITNESS: This is -- okay. Here's what
   24       happened. Here's the consequence of events. The fax, the
   25       original was typed out and printed out on a real piece of

     2                            THE COURT: But that doesn't look like an

   3        original. It's --
   4                            THE WITNESS: No, no, no. Okay. This -- then it
   5        was faxed in a fax machine to Cancun, Mexico to Joseph Andy
   6        Mann. Andy Mann said fine. It's fine. Now, go ahead and
   7        affix your corporate seal to the top, right-hand side and
   8        Fed Ex it to me.
   9                  Then he did that. We Fed Ex'd it to him. Then it --
   10       it disappeared. The next time we saw it was like this in
   11       Bruce Judd's lawsuit from First Concorde. That's the next

   12        time we saw it. We didn't see it, anymore.                                                   It was

   13        absolutely gone, history. It didn't exist.

   14                  And it shows up with this paid stamp on both of them.
   15        And Bruce Judd wrote D on C on both of these. Probably if
   16        we check his writing, we'll find it's his writing.
   17                            MR. MONTAL: Objection, your Honor. There's no
   18        foundation as to who wrote anything on this document.
