It is illegal under the 1948 Genocide Convention (to which Yugoslavia is a signatory party) for a country to commit genocide against even a seceding province (de facto country). Yugoslavia as a successor nation to Serbia is obligated to protect its minorities against oppression under its World War I peace treaty.

The Court upheld the application of the Genocide Convention against Yugoslav objections by a huge majority. Read the judges opinions for a good look at the evolution of anti-genocide international law.
