It may have the semblence of law on paper, but in practice, how can you say it has the force of law? If the state of Texas makes it illegal to drink and drive, and I am caught drunk, I am legally responsible and the state has justified recourse against me, it is legitimate authority. At the same time, if Texas passed such a law, but the Supreme Court or Congress has ruled or passed legislation saying that it is not against the law, the US government has a legal recourse against the State of Texas, its authority over the state is justified and legitimate authority. Neither I nor the State of Texas can refuse judgement and simply withdraw from the authority of the Federal government. The UN, however, has no such legal power of recourse against the government of the US, and relies upon what is essentially the honor system. The UN can spit and sputter and bitch and moan, but the US can simply say, "No. Sorry, wont do it." This is hollow legalism. The real authority behind the UN, like it or not, is the principle of reciprocity and when that fails to bring compliance, GUNS. It is the same age old ways dressed up in legal jargon and made pretty on paper. When push comes to shove there is nothing in the world that can make *any* state comply with this so-called international law except the expectation that other states will reciprocate, and in worst case, that the authority of the UN is backed by cannon, most noteably US cannon. Call it what you will, law or not, it is still power politics and nations still do as they please and play their high poker games. Its still the State of International Nature.
