Actually there is another way of looking at this. It might be in the best interest of the insurance company representing Anderson's firm to settle as soon as possible to limit the award for financial damages. After all if their negligence eventually results in the bankruptcy of the company the damages would increase considerably. They also have to consider the ongoing loss of revenue from the processor not producing.

Can someone that has read the court documents or is more knowledgeable comment on this ?

I think this pretty much sums it up. The last Chinese JV was to good to be true. At this stage of the game any deal would be a great deal.
