The US constitution clearly spells out that your life may be taken.

Where exactly does it spell that out, X? Are you referring to the 5th Amendment? That is, to the following passage:

...no person... shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law...

??

If so, that passage merely recognizes the practice of the day, when capital punishment was universal.

But you're the lawyer...

P.S. on the Death Penalty & the U.S. Constitution

Just remembered. The ACLU argues that the death penalty violates the 8th Amendment to the Constitution:

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.
