Quiel came across very poorly. He clearly was not an independent witness and even without analyzing his statements he made that loud and clear with his attempts to spar with the attorneys involved in cross examination, his games with his memory, and his lack of cooperation. Those are not the characteristics of an independent witness.

Of course, when one considers his relationship to the company, the Sylvers, and Titan, (of course being a significant shareholder makes it difficult to be completely independent too as is pointed out that every .25 increase equates to $150,000) it is easy to appreciate the fact that he is not independent as the court itself recognizes. Quiel is a huge red flag.

Why would Titan sell shares to him below market? <g>
