You are absolutely correct - that's what I meant with "holding positions", because that's essentially why the wash sale rule exists, because for the law you are "holding" a position when you re-enter so soon (30 days).
My question is: Is the Broker(like DATEK) giving you in the 1099-B sales list a grand total of all sales WITHOUT the excluded wash sales in Dec98? So that when you exclude those wash sales you can match the grand yearly total?
