I do take exception with your statement that without the British common law, America would have none. The Spanish, French, German and Dutch colonies all had well-developed legal systems. The Civil Law, which originated in the Mediterranean, was codified in Greece and in Rome, is far more widespread than the English common law, and is in force in Central America, South America, and most of Europe, including Scotland.

Wisdom is not defined, nor gauged, according to the # of people who cast a yea or nay vote on any issue.

Wisdom, perhaps not, but law is, and law, in the society you so admire, is what passes for collective wisdom. Would you have it otherwise? Would you have our morality defined not by the vote, but by the pronouncements of religious zealots?

That wouldn't be very American, would it?

And but for, British common law, America would have none.

Absurd, and grammatically atrocious as well. All people have laws. If the Spanish had succeeded in conquering Britain in 1588, we would not have British-based laws, but we would still have laws, though probably different ones. Abortion would probably be illegal, for one thing. Would you consider that an improvement?
