Aber has been particularly stupid (negligent IMO). If you look at page 16 of the WSP information circular, you will note that: the Camsell Lake JV agreement provides that if Aber fails to provide written notice of Aber's election to contribute its proportionate share of the said budget, within the time set out in the JV agreement, the applicable party is deemed to have elected to not contribute to said budget.....there you have it....plain and simple....end of story...let the class actions against Aber directors and management begin....but without prejudice....who knows how many billions the claim could be worth.....
