Here's an interesting analysis of that odd "open-source" trial baloon that was floated last week.

Microsoft's open-source gambit
Is Redmond seriously "thinking" about releasing its source code --
or just trying to confuse the opposition?

salonmagazine.com

The author considers three possible interpretations:
1) It's all a show for the court.
2) Microsoft is genuinely worried, and it's fighting dirty.
3) There's a real internal debate about open source inside Microsoft.

Part of his conclusion:
...This change cuts too close
to the core of not only Microsoft's business model but
its psyche. Truly releasing the Windows source code
wouldn't just mean adjusting some spreadsheets -- it
would require thousands of Microsoft employees to
change the way they think....
