Exactly right. But AOL thinks they can pressure congress into demanding that cable operators allow them to become ISPs. The argument is

"the big bad monopoly cable businesses will not allow us to become ISPs. Tell them they have to do it congress. Mandate rates."

The argument plays well with the uninformed public. Everybody hates cable. Politicians do not want to be seen as cable yes men.

Here is an example of how the public (and editors that shoud know better) eat up the AOL argument without giving any serious thought to the issue:
