As I said privately, if you really DO have a lawyer on retainer, let him deal with it. My guess is that they count on being able to intimidate you as a private person.

Also: why SHOULDN'T it have the "look and feel" of a BizWire release? You PAID for a BizWire release, after all. And they have a prominent disclaimer in which they reject all responsibility for the content of releases published by them. So what's their PROBLEM??

And I'd love to see them argue the "Bidness Wire" copyright thing in court. With straight faces all round, uh-huh. Do they want to make utter and permanent fools of themselves, and not just April ones?

>>>>So, what do we do?<<<

You might try sending Linda Kaplan to talk to them. If she was there over an hour I figure the lawyers would either give up or quit just to get away from her.

Jeff,

Thanks for lobbing me this softball of a decision.

It's obvious they (BW) don't know who they are dealing with. The best defense is a good offense. I noticed that www.bidnesswire.com is still available. First we snap up this domain name, then we build a direct parody of BW and their actions and send out a release announcing the site. We should probably use PR Newswire for this. If the site doesn't tick BW off, the loss of revenue will. Concurrent with these actions we trademark "FBNA" and "Bidness Wire." They can't sue us for using our own trademark, can they?
