I concur with Mama Bear that Liviakis is bluffing, and won't serve anyone because it will open his files to discovery, which he can ill afford. He's trying to scare people. You can file a lawsuit against unknown persons, and then you can "prepare" to subpoena Yahoo's records to find out their identities, all without serving any defendants.
