Whether ILEC investments had to be in a separate entity or what I don't recall, but the gist was that if CLECs could build new networks without having to share, so could the ILEC as long as they didn't unfairly advantage themselves in interfacing to the regulated legacy plant. I'm frustrated by SI's 120-day limit on searches. I remember drilling down on this in some detail and writing about it on the AMTX thread back in 1997, but 30,000 posts is a lot to search through by hand. Of course things might well have changed again since then. I'll dig around.
