Criminal intent- might that not stretch to doing something a reasonable person should know will cause people to act? Any reasonable person knows or should know that putting out a fake press release (that is not CLEARLY labeled a fake) will cause some people to buy or sell, who would not ordinarily have bought or sold. I do not think one need profit to have criminal intent (like yelling fire in a crowded theatre).
