In a suit filed as a class-action Wednesday in Los Angeles County Superior Court, investor Matthew Rosenberg claims that even if an E*Trade customer indicates an interest in a new IPO through an on-line bulletin board, the offering is either unavailable or not available in any meaningful amount. "The company's success has been fueled, in part, by advertising aimed at convincing potential customers that if they open accounts with E*Trade they will have access to Initial Public Offerings," Rosenberg said in the suit.

Moron. What does he expect when multiple underwriters are splitting one or a few million shares? There aren't many available. And you certainly do get access to IPOs as I've gotten four good ones now.

I would love to send this guy a package in the mail to let him know how pleased I am with his "wise" lawsuit.

Talk about sour grapes. My god, I had a question about why I did not get Value America shares with a 5:23 timestamp and Etrade corrected the problem within a few days. (i.e. I got an allocation.)

I wish people in this country would try and solve problems themselves instead of running to a lawyer everytime they have a problem.

What a jerk.
