Hey, Dave MG, gdichaz: re. CC, patent expiration and LWIN

Dave: My notes are in the office. If you haven't retrieved a full playback by manana, let me know and I'll post from Volpe Brown on. But re. his question on long do patents last, I remember it very clearly because it was, to me, one of the most astounding aspects of the call, imo.

The first answer to the question was by Dr. J, who said, as we know, that Q is adding to its patent portfolio all the time, as if to say, don't worry, we keep adding so the patent expirations (on the NEW patents) keep extending. I was disappointed with that response, because I thought that Dr. J might be ducking an issue regarding "essential patents", which I recall from the Q-ERICY CC to be the key basis on which the royalty allocation (favorable to Q) was based. But then, I believe it was Steve of the ASIC Division, who made the following statement, more or less verbatim: under the Q's license agreements, if you a licensee of one patent it is the same as being a licensee for the entire portfolio--the rate is the same. This is not my understanding of how a typical IPR license normally works. If true, it is astounding and DOES imply an evolving expiration.

There's a replay of the call @ (800) 633-8284..code#11944983
Market is stronger than QCOM has anticipated.
QCOM has set a worldwide CDMA standard, which QCOM has the
patent rights to and royalty revenues which will be increasing in
substantial amounts going forward. Qualcomm has set :
A single CDMA standard set worldwide with 3 operational modes
compatible with all the other major worldwide standards(networks),
with are backwardly compatible.

Much more information about the next generations of
cell phone chips to be released this current quarter.
Improvement in gross margins is foreseen.
250 % increase in operating earnings from last year.
Inventories down , sales up, demand strong everywhere.
Royalties moving upward going forward(figured conservatively),
Pro forma basis earnings are a $1.20 per share this quarter,
The rest of 1999 and fy2000 QCOM is very enthused about,
Demand so strong, worried about supply shortage.
$5.00 is a low ball conservative number now for FY2000 earnings,
98 mil. verse 65 mil. in pro forma basis up 50.7% from last year
All analyst congratulate QCOM on the quarterly results
A very strong quarter, and foresee the markets remaining strong
Management not prepared to quantify numbers for FY2000,
Market has been too strong for management to give any
good guidance at that this time.
Component shortages?? Sony giving QCOM preferential treatment

Exstatic to be aboard.

What should we realistcly see in price action short term?

Got some May 135s.

I think the recent market turbulence created one of the biggest bear traps I have ever seen.

Any comments?
