Here are some Trademarked names that do not exist as of yet, to the best of our knowledge: MAXUNIVERSE, MAXWORLD, MAXMANIA, MAXNOW, JUSTMAX, CRAZYMAX, MAXTODAY, OURMAX. So, I am sure MXNT will not have a problem in selecting a new name and or Trademarked name if they decide they must. Many companies have divisions and subsidiary names that have inadvertently crossed another company's trademarked property. And it is not always a clear-cut objective determination as to whether or not there has been a problem with what is often called "Similarly Confusing". This happens thousands of times.

In this situation, we have what I think are two "tiny" companies that have a dispute over the use of a Trademarked name relating to two International Classes. There are approximately 43 Classes. Perhaps MXNT thought those 2 Classes did not apply to what they were using their name for. This is just a guess on my part.

If you look at the following, you will see International Class 037 and 042. This might be one of the issues.

If you go here:http://trademarks.uspto.gov/cgi-bin/simple_srch4?TRADEMARK+3
you will see MAXNET used several times. Everything is not as simple as it may appear with Trademarked names and corporate names. There can be lots of legitimate confusion and gray areas.
