If they apply for an injunction they better be very sure they will win because if they don't they will be responsible for all costs from the time of the injunction to the time of the verdict at the end of the trial. This could easily be 4 years. Worse, they could definately be sued for lost opportunity by the competitor if BII chose not to allow them to use the technology under license (during the injunctive period).
