I searched the U.S. Patent Office under "Dutch Auction" and found that Onsale was granted a patent on Nov 10/1998 for several auction processes including a Dutch Auction. Their Dutch Auction does not appear to be a declining price auction. However, a part of the patent covers another auction process which is a declining price auction.

After reading Onsales patent I am somewhat skeptical of the value of Bid.coms patent.
