I sold for $33 11/16 average. This deal won't be done in 5 days, more likely a month or two, maybe longer. The fact that it's cash will help speed things along. All that "Commence tender offer" statement means is that all holders of the stock will be mailed a little something where they can vote for or against the bid. All will go well and the bid will be approved, then the lawyers have to drag ass for several weeks finalizing everything, then finally you get paid the $35.
As a perfect example look at Computer Associates(CA) buyout of Platinum.(PLAT) It's for $29 1/4 cash, and the offer was mailed to shareholders a couple of weeks ago. PLAT is still selling in the $25's. Where FORE gets you 5% arbing it, PLAT gets you 15% and it's further along in the process. AOL buying NSCP took months to close, ATHM/XCIT still hasn't, but those are stock swaps and can take longer.
One reason FORE may be so close to it's takeout price right now is the possibility of a second offer coming in, though it's of course slim.
A few more like this and I could start liking Mondays.
