Vivus IR has confirmed that they are still retaining CSFB as a consultant to explore strategic alternatives.

I'm still a little puzzled of James Kelly's participation in the CC. Shouldn't he be aware of their situation better than Lee?

I dig. The question then would be is there a drug involved. If not then I want to buy their stock. Even more important is the thought that another company (PFE,ICOS,HVSF,LILLY you name them) might easily buy the patent rights and have the clout to give Vivus some trouble.
