When a judge has a written agreement in front of him and the agreement has already been applied there is very little for the judge to decide. As an exceedingly wise Canadian politician once said, verbal promises are not worth the paper that they are written on.
There is no need to wander into a he said-she said and who misunderstood the most. The notice was not sent, the check was not sent, Aber is diluted. End of story.
Now the question is how much money does Aber want to spend on denial?

I stand corrected......I should have said that Aber's allegations are contended by Winspear to be spurious and fictional.....What I meant was, is that IMO, if it comes down to Aber's word versus Winspear's word, I believe the agreement will prevail.....and goodbye Aber.....by the way, is the use of the term "spurious", lawyer talk for calling someone a liar?
