I, too, hope this safety net doesn't have to be used. It's like your car insurance policy, you hope you never need to use it but it is comforting to know that it is there. If Mr. Gordon and his associates can get their game plan up and running to provide necessary cash flow, then the "safety net" will not be needed and the corporation can cancel the agreement and settle up any open balances per Mr. Gordon's option. I sincerely hope this happens sooner than later. It will be the one of the first signs that the company is meeting with some success.

Marty's contributions are indeed numerous both physical, getting Mr. Hwang introduced and mental, keeping this thread's collective sanity intact. I really believe that he could not perform the same functions as a member of the BOD due to constraints that would be placed upon him from a corporate and legal perspective, even with the liberal use of disclaimers and "forward looking" boilerplate.

If he were able to do that, then so should any member of the company from the CEO down to the in-house janitor (who probably knows a lot more than he/she should know) be permitted to say things in a public forum without any recrimination. Alas, the real world says "No way."

I truly don't think we can have it both ways.
