Scott, what a horror story. 52K is an awful lot of money to have go into the ether. Glad you got it back. Try not to think of what you were going to do with it on those days. Maybe AOL at ? Or a little NSOL.

And you're absolutely right, the money in my account was someone else's money. No, I didn't start trading on Monday with the funds but interestingly enough I finally got a response from DATEK that day. They called me not because I'd called them twice and FAXED them about the mistake BUT BECAUSE AN EMPLOYEE READ MY POST HERE ON SI.

Moral of the tale: Can customer service. Use SI - DATEK BOARD to get heard!

In all fairness, I haven't had any other problems with DATEK especially the 9 to 10 a.m. problems I've read so much about. On the other hand, I've been wondering if some of these fellows worked security at our nuclear weps labs.

$12,003 poorer - waiting for my IRA's to transfer from Fidelity. Wondering what the market will be like six weeks from now when I get it.

This is a horrible story. Just wondering, do you have your name and account # on that check? If they are on your check, even if that person were not honest, you do have your cancelled check to prove it, don't you?
