i believe that you've hit it on the head

the Swiss are overseas and probably doing their shorting through some large US-based institution

large funds, brokerages etc can short anything if you have enough clout and funds

there are no laws prohibiting one from shorting any stock on basis of price - just have to have the funds to make your broker feel warm n fuzzy in case you have to cover any potential losses

one always hears of cases in which professional shorters short a small company's stock into the dust via canadian brokers - it happens and there are some pending lawsuits currently by companies against their convertible holders (i posted such info on this thread some time ago thinking that JMAR might be able to after the swiss vermin but they have no inclination to do so apparently)
