The Swiss may have gotten around the law because they actually sold the shares short before they took delivery of the million shares and 250,000 warrants. This is what is indicated by the 3rd qtr '97 10Q filed on 11/14/97 which stated JMAR had received subscriptions for 250,000 plus units (four shares and one warrant each) . However, it stated the sale had not been completed.

The shares were sold short prior to 11/15/97 when shorts jumped from 7,824 to over 750,000. Twenty-five percent of the shares were to become unrestricted each quarter until 11/20/98 when all restrictions were lifted. This , also, indicates the sale was not completed until 11/20/97.

If the Swiss were in fact the short sellers, why have they not covered their short position?
