I don't know, seems to me you shot your own argument in the foot.

Your reference from their site:

This says the Business Wire member is solely responsible for the accuracy, originality AND FACTUAL CONTENT of all materials SUBMITTED FOR DISTRIBUTION.

Your reference from the complaint:

However, Business Wire does act to ensure that the information it provides is accurate by requiring, as a condition of distributing any press release over its wire service and on its website, that the person or entity submitting the press release warrant that the factual content in the materials submitted for distribution by Business Wire is true and accurate.

Again, it states the person or entity submitting the press release warrant that the FACTUAL CONTENT in the materials submitted FOR DISTRIBUTION IS TRUE and accurate.

They both say the same thing it seems.

I myself am interested in the concept of "irreparable harm", and how it might be proved in this case.
