Yes, this is the rule that individuals need to follow in order to short a stock. However, Market Makers do not have to follow this rule.

Yes, but it's not that hard to get an uptick of 1/16 unless a stock is in a free fall.

Here is a quote from the Bear Tracker:

"A short sale cannot occur in a stock that is falling in price. This is known as the "uptick rule" and is an SEC regulation. The rule is intended to prevent short sellers from profiting by driving down the price of an already battered stock through successive waves of sell orders."

I don't see a "free fall" for LOAX, but I do think the price goes lower from here, IMO.
