JLA--- I am out of order due to frustration with the server...Of course he meant to say restraint, but it is inapplicable unless the Court tries to rule on Roe v. Wade when the issue of its underlying validity is not germane. Additionally, even liberal critics of Roe think that it was over-reaching itself. Therefore, one is left with Ronald Dworkin's argument that even a conservative court should not unsettle the law, which is more or less the position that O'Connor articulated the lasttime this came up...
