FINANCIAL SERVICES PRACTICE The Gardere & Wynne Financial Services Practice is composed of a group of attorneys who provide a wide variety of legal services in the areas of general banking, bankruptcy and creditors' rights, and litigation.
General Banking The attorneys in the Banking Group have particular expertise in structuring, documenting, and closing debt-related financial transactions and in regulatory issues generally affecting financial transactions and financial institutions. Clients represented include money center and super-regional banks, commercial finance companies, venture capital firms, small business investment companies and regional and local banks, thrifts, and credit unions. Transactions handled by members of the Banking Group range from relatively simple working capital and term loans to large, complex transactions such as domestic and foreign syndicated loans, acquisition financings, equipment leases, sale/leasebacks, project finance transactions, letter of credit facilities, industrial development bonds, asset securitizations, including collateralized bond obligation transactions, subordinate and mezzanine loans, debt/equity hybrid transactions, and commodity, currency and interest rate swaps. The members of the Banking Group have experience in financing transactions involving a broad range of industries such as real estate, oil and gas, utilities, telecommunications, high tech, health care, media and financial institutions.
Bankruptcy & Creditors' Rights Attorneys in the Creditors' Rights and Bankruptcy Group have developed a significant and varied practice dealing with problem loans and other difficult credit transactions. They have substantial expertise in private and public debt restructuring, and represent financial institutions with regard to corporate domestic loan restructurings and as secured creditors in reorganizations. Additionally, these attorneys have extensive experience as counsel to debtors-in-possession, secured and unsecured creditors' committees, trustees and purchasers of assets from bankrupt estates. Members in this practice area are experienced courtroom advocates.
Litigation Aggressiveness in using the courts to gain quick results is a hallmark of Gardere & Wynne's creditor representation expertise. The Firm has one of the largest litigation sections in Texas, a significant part of the which is devoted to financial institutions and creditors' rights work with particular emphasis on collection matters, lender liability claims and other litigation matters unique to financial institutions.
