In my Torts class we discussed the jock who accidentally broke his girlfriend's neck when he had her in a hammerlock to give her noogies. Most agreed that it was negligence on his part, a breach of the duty we all owe each other not to injure each other.

His insensitivity to others is obvious, if that's what you mean by "not understanding it as harm." But, I saw the beginning of the fight, and Joan did provoke him.
