SI could be considered actively managed -- a "publisher" -- since GNET employees monitor and sometimes delete messages for various reasons.

Actually, I think that SI has most of their bases covered in the legal arena. They may monitor the messages, but primarily it is to oversee member to member interaction and keep the peace between them.

AOL and the Motley Fool are little different from SI when it comes to TOS violations and punative measures. They're not acting as active moderators of a discussion, but more as baby-sitters of the unruly membership.

I'm not overly concerned about the DCI case. People can go and review the interplay and exchange on the DCIC thread and decide for themselves.
