For the sake of humble argument, fiction as it were, conjecture and speculation, all in my humble opinion only, of course . . .

May I humbly consider the other side of the "coin?"

The side where money exchanged hands for a service to be rendered by [reference deleted]?

Was the service preformed? Fully? As advertised?

WEBDUD3, you are indeed adept at finding definitions of fraud. Now, can you find a single case of BW suing a REAL company for fraudulent statements involving REAL money and REAL victims who suffered harm?
