It sounds very cool to talk about tort reform and frivolous lawsuits until you or someone close to you are the one injured, whether it be in a business matter or a matter involving personal injury. State and federal statutes have sanctions available for victims of frivolous lawsuits. See Rule 11 FRCP for instance. This is not a black and white issue although those who would benefit from being able to run roughshod over you would like you to think so.
