In the old days (roughly a century ago) it took a Republican like Teddy Roosevelt to take on JD Rockefeller and the cigarette gang. The results of those actions, which resulted in significant divestitures of both industries, weren't all that devastating to the industries -- but it did make for good populist theater. Go after the guys with sharp elbows! -- even though they're lowering costs and creating enormous economies of scale and rationalizing a new industry. The public loved it.

So what's driving the Clinton types in this holy war? Not economics, that's becoming more apparent all the time. There is no way for the DOJ or the courts to regulate this industry with policies that will look intelligent a few decades (or a few months?) from now. It's not populist demands or commies but the screams of OTHER BIG COMPANIES that are propelling this. That's what's bizarre--and fascinating to watch. I can't believe that when all is said and done that Jackson or our appellate courts will make a decision that defies so much economic logic.
