Because there are those little factors called "time" and "window of opportunity". It is going to take additional time to expand and actually put into use ARTT licenses. If ARTT is forced into bankruptcy, other companies will be denied the licenses for a long time over which WCII and Teligent can continue opening new markets.

ARTT has one advantage in its corner with regards to forcing a deal by June, Lucent, which does not want ARTT to default on hundreds of millions in vendor financing.
